Kevin Costner’s wife Christine Baumgartner ordered to vacate couple’s home by judge

Kevin Costner‘s estranged wife Christine Baumgartner has been ordered by a judge to vacate the couple’s California home by July 31.

According to TMZ, the presiding judge enforced a section of the couple’s prenup which stipulated that if a divorce was filed that Baumgartner, 49, would have a certain number of days to leave the family home.

Baumgartner’s legal team have argued that the move out date is unfair as she will not have sufficient time or money to find an alternative living arrangement. Her attorney reportedly requested an extension to August 15.

It’s being reported the judge’s decision to uphold an aspect of the Costner’s prenup could spell trouble for Baumgartner, whose legal team have allegedly planned to question the legal legitimacy of the couple’s prenup agreement.

If the prenup is accepted as legally valid, Baumgartner may have to return any money that Costner, 68, has given her and cover Costner’s attorney’s fees for defending the prenup in court.

This news comes just days after court documents alleged that Costner actually requested his estranged wife vacate the home by July 14.

In court filings obtained by People regarding the couple’s divorce, it has been revealed that Costner requested on June 30 that Baumgartner leave his California home by July 14.

In the filing, the actor’s legal team alleges that Baumgartner, 49, “grasps at straws with one baseless argument after another,” as to why she should stay at the couple’s residence.

Besides the dispute over living arrangements, the couple have also disputed over what Baumgartner will be paid in child support.

Baumgartner and Costner share three children together, Cayden, 16, Hayes, 14, and Grace, 13. Baumgartner has subsequently requested US$248,000 (approx. $374,735) per month in child support, a figure which Costner has rejected as “inflated.” 

Just last week, Costner stunningly claimed that his wife’s request for US$248,000 in child support payments is to fund her plastic surgery.

Baumgartner initially filed for divorce on May 1 after 18 years of marriage.
